Eligibility You must be: • At least 18 years old • Authorized by your organization to access Sabian services • Using Sabian in a professional, not consumer, capacity Sabian does not offer consumer-grade services. 3. Client Data & Operational Data 3.1 Ownership All operational, industrial, plant, refinery, process, or strategic data you provide or connect to Sabian remains 100% your property. Sabian does not claim ownership over client operational data. 3.2 Data Handling Unless explicitly authorized by contract: • Sabian does not export operational data • Sabian does not share operational data • Sabian does not use client data for model training • Sabian does not store plant-level telemetry outside your controlled environment • Sabian does not transfer industrial data to third parties This applies to all sensor data, equipment signals, process variables, production metrics, and any other operational inputs. 3.3 Confidentiality Sabian treats all client information, including operational data and strategic communications, as strictly confidential. 4. Acceptable Use You agree not to: • Reverse engineer, copy, or modify Sabian systems • Attempt unauthorized access or interfere with Sabian infrastructure • Use Sabian to violate any laws, sanctions, or export controls • Upload malicious code, harmful scripts, or security threats • Use Sabian outputs to mislead investors, regulators, or government agencies Sabian may suspend or terminate access for violations. 5. Accuracy & Limitations Sabian provides intelligence, analysis, and recommendations based on available data sources. You acknowledge and agree that: • No AI system can guarantee perfect accuracy • Outputs may depend on data quality, environmental variables, and real-time factors • Final operational decisions remain the responsibility of the client Sabian is an analytical and decision-support system — not a replacement for certified engineers or licensed professionals. 6. Security Sabian implements rigorous, sovereign-grade security measures, including encryption, access control, and environment segmentation. However, no system is entirely immune from risk. By using Sabian, you acknowledge: • You must maintain secure access to your own systems • You are responsible for safeguarding your login credentials • Sabian is not liable for breaches resulting from your network or user behavior 7. Intellectual Property All Sabian technology, including: • Software • Algorithms • Voice briefings • System logic • Visualizations • Invented methodologies • Documentation • Branding and trademarks …are owned exclusively by Sabian and protected by intellectual property laws. You are granted a limited, non-transferable, revocable license to use Sabian in accordance with these Terms and applicable contracts. You may not copy, resell, sublicense, distribute, or create derivative works of Sabian systems. 8. Third-Party Integrations If Sabian integrates with your internal systems, sensors, or third-party tools: • You remain responsible for compliance with those third-party terms • Sabian is not liable for third-party failures, outages, or data inaccuracies • Integrations may require additional agreements or permissions 9. Payment & Subscriptions Fees, billing terms, and service levels are defined in your contract, proposal, or invoice. Failure to pay may result in suspension or termination of access. 10. Termination Sabian may suspend or terminate access if: • You violate these Terms • You violate security policies • You misuse the platform • Payment obligations are not met • Sabian determines your usage poses risk to its systems or other clients Upon termination: • Your access ends • Your operational data remains yours • Sabian deletes stored personal data as required by law • Any contractual clauses survive termination as applicable 11. Disclaimers Sabian provides its services “as is” and “as available” without warranties of any kind, including: • Performance guarantees • Accuracy guarantees • Uptime guarantees (unless contractually defined) • Warranty of fitness for a particular purpose Sabian disclaims liability for: • Production losses • Industrial downtime • Business interruption • Indirect or consequential damages unless required by law or covered by a specific contract. 12. Limitation of Liability To the maximum extent permitted by law, Sabian’s total liability shall not exceed the fees paid by you for the service within the preceding 12 months.
